What is Gross Misconduct

Gross misconduct is an employee’s action that is so bad they can be fired without notice. Gross misconduct encompasses activities that destroy the trust between the employer and the employee. What may count as gross misconduct varies between industries and companies. However, theft, embezzlement, damage to the company, and being under the influence of drugs or alcohol at work are generally considered gross misconduct.
While these are grounds for dismissal, companies cannot fire someone right there and then. You must still follow the proper procedure for firing someone, or they may be able to claim unfair dismissal, posing a risk for your organization.
